Building permits are processed by the Building Division.
Applications for Building Permits
Applications for building permits can be obtained at the Building Division located at 74 Audrey Ave in Oyster Bay as well as the Building Division Annex located in Town Hall South (977 Hicksville Rd in Massapequa). In addition, the application as well as other forms can be downloaded from the Town of Oyster Bay website. Applications for new construction generally must be submitted with a copy of the survey and two copies of the building construction plan.

Projects requiring Building Permits
Types of projects that generally require permits include, but are not limited to, the following:
- All houses and buildings
- All additions to houses and buildings
- Any interior alterations
- Change or rearrangement in the structural parts or in the exit facilities of any building
- Any inground or above ground swimming pool of a depth of 18″ or greater
- Swimming pool cabanas
- Swimming pool heaters
- Hot tubs
- Any fence more than four feet in height
- Demolition of any structure
- Any raised deck more than eight inches in height above grade
- All patio roofs except canvas
- Vestibule covers and enclosures
- Any shed more than 100 square feet in area
- All fireplaces and chimneys, including prefabricated
- Freestanding air conditioning units
- Retaining walls two feet high or higher
- Sewers, drywells and cesspools
- Plumbing fixtures
- Oil and gas tanks
- Oil and gas heating units
- Tennis courts
- Garages and accessory structures
- Tents
- Trailers
- Greenhouses and passive solar structures
- Solar panels
- Conversion of garages to habitable space
- Fire damage repair

Certificate of Occupancy
The Building Division also issues certificates of occupancy and regulates the maximum occupancy in places of public assembly.
